Road Traffic Accident Personal Injury Case
Mr CLM was driving along the left lane of the dual carriageway when the defendant’s vehicle suddenly collided into the rear driver side of the claimant’s vehicle. The driver of this third party vehicle was untraceable and as a victim of an insured hit and run driver, Mr CLM’s claim was put through to the Motor Insurer’ Bureau (MIB).
Accident Circumstances
The third party was driving at high speed as he was being pursued by an undercover police car on the dual carriageway. When attempting to drive through a gap between Mr CLM’s car and the car next to it, the third party struck our client’s vehicle from the rear corner of the driver’s side.
Police nearby to the scene of the accident were able to provide the registration of the third party vehicle and it was evident from this that the car was uninsured.
The client was unable to work as a private taxi driver and so needed a hire car to be able to continue working, which was arranged by us. Also, we arranged for the client’s car to be picked up and stored.
Injuries Sustained
Mr CLM suffered the following injuries as a result of this accident:
- Whiplash
- Soft tissue injuries to head, neck and back
- Suffered from headaches
The claimant was prescribed pain killers by his doctor and had to undergo physiotherapy sessions, which were arranged by us.
Gathering Evidence
Since the third party could not be traced, we advised to claim through MIB which provided compensation for the costs of repair, car hire and general damages. Police reports were obtained and during the time of the car repairs and the ongoing investigation by the MIB, we worked to recover the losses suffered by our client.
In order for us to carry out all enquiries, we communicated with the police, took statements from the client and witnesses, and arranged the medical examination for the client. We prepared all documents relating to the medical condition of the client, the vehicle damages report and hire rental agreement. Finally we collated all findings and evidence and liaised with the MIB to release a payment to our client during the ongoing investigation. Following this, our client received an interim payment so that the vehicle could be fixed promptly.
Outcome
After receiving our evidence, the MIB agreed to settle the claim at an early stage, and payment was released to our client.
Final Settlement
Mr CLM was awarded a total of £36,762 made up as follows:
- £3,530 for General damages
- £30,706 for Hire, storage and recovery payment
- £2,526 for Vehicle damages
