      There are several ways you can apply for UK Permanent Residence

      Family Visa

      Partners, spouses, and relatives of UK residents who have gained permanent residence or British Citizenship may qualify for UK Permanent Residence after 5 years. This includes the Spouse Visa, Child Visa, UK Ancestry Visa, and Adult Dependant Visa.

        The specific terminology used may depend on the immigration context, such as whether the individual is an EU citizen covered by the EU Settlement Scheme or a non-European national under general UK immigration rules. Indefinite Leave to Remain is a status granted to individuals who have been living in the UK for a specific period, usually after completing a qualifying period of continuous residence. UK Permanent Residence is often associated with European nationals and their family members who were granted the right to live in the UK under the EU law before Brexit.

For instance, individuals with an Innovator Founder Visa or a Global Talent Visa may be eligible for UK Permanent Residence after only 3 years.

        Qualifying for UK Permanent Residence: Family Visa

        If you’re a family member of someone settled in the UK, which includes partners/spouses, children, and dependent relatives, you may qualify for UK Permanent Residence. This is applicable when a UK resident has gained permanent residence or is a British citizen.         To successfully apply for Indefinite Leave to Remain in this category, you must meet residency requirements, fulfil the relationship criteria, satisfy financial prerequisites, pass the Life in the UK test, and meet English language requirements.

        Qualifying for UK Permanent Residence: Work Visa

        Work Visas, like the Skilled Worker Visa, grant the opportunity to work for a UK employer. Typically, individuals can secure UK Permanent Residence after holding a work visa for 5 years. The Skilled Worker Visa is particularly accessible for non-EU nationals looking to achieve Indefinite Leave to Remain.

        Other work visas leading to Indefinite Leave to Remain include the Health and Care Worker Visa, and Global Talent Visa. However, it’s essential to note that not all work visas qualify for Indefinite Leave to Remain, such as the Senior or Specialist Worker Visa and the High Potential Individual (HPI) Visa. While the HPI Visa doesn’t provide a direct route to Indefinite Leave to Remain, it offers other advantages, allowing students to work in the UK without a job offer.

        To gain Indefinite Leave to Remain via a Work Visa, you must meet residency requirements, maintain sponsorship by your UK-based employer, continue to work in a qualifying job, meet minimum income prerequisites, pass the Life in the UK test, and fulfil English language requirements.

        Qualifying for UK Permanent Residence: Business Visa

        Innovative entrepreneurs can consider the Innovator Visa, offering a quicker path to Indefinite Leave to Remain for non-EU nationals. With this visa, you can gain Indefinite Leave to Remain in the UK after just 3 years. However, not all business visas provide a direct route to Indefinite Leave to Remain, such as the Start-up Visa, which requires switching to an Innovator Visa to attain Indefinite Leave to Remain.

        To qualify for Indefinite Leave to Remain as an Innovator Visa holder, you must meet residency requirements, have a new endorsement for your business, pass the Life in the UK test, and fulfil English language requirements.

        Qualifying for UK Permanent Residence: EU Nationals Post-Brexit

        Following Brexit, EU nationals seeking UK Permanent Residence in the UK must apply under the EU settlement scheme. If you came to the UK before January 31, 2021, you might be eligible for Pre-Settled or Settled Status. Pre-Settled Status is for those who haven’t lived in the UK for 5 years yet, while Settled Status is granted after 5 years of continuous residency. EU nationals who arrived in the UK after 31st January 2021 can explore the visa routes outlined above to attain UK Permanent Residence.

        How much immigration services cost?

        In most instances, we operate on a Fixed Fee basis for working on your case. This means that we will agree our fees with you before we start the case and they will not change. Please note that our quoted prices are only for our professional services fees. Our prices do not include any payments that need to be made by you to a third party such as the Home Office, Court Service, UK Visa and Citizenship Application Service (UKCAS), experts or interpreters if required.

        In some circumstances, the fees may be lower or higher than the prices listed below depending on the nature/complexity of the matter, whether the applicant has been refused previously and the anticipated amount of time involved. Should an uplift be needed, that will be agreed before the work is undertaken and the reason/s for it explained.

        All professional fees include time for preparation and submission of immigration applications, submissions and appeals. The fees include: remote and in-person client meetings, consideration of documents, the taking of instructions and providing advice on the options available, law & procedure, documentary requirement, likely timescales, corresponding with other parties/experts/the Home Office/courts, keeping you updated and preparing and submitting the application/submissions/appeal as appropriate.

        Our fees also cover alerting you to any changes in the law which may have an impact on your circumstances during the course of your matter. Should urgent and/or “out of hours” work need to be undertaken, an uplift may be applied which we would agree with you.
